These Terms & Conditions apply to all services provided by Upton's Electrical & Security Ltd, Company Number 16637306, registered in England & Wales ("we", "us", "our"). By accepting a quote or instructing us to carry out work, you agree to these terms. Please read them carefully. If you have any questions, contact us before work begins.
1. Our Services
We provide electrical installation, testing, inspection, and security services including but not limited to: domestic and commercial electrical work, agricultural electrical installations, EICRs, EV charger installation, CCTV installation, intruder alarm systems, and data & Wi-Fi infrastructure.
All work is carried out by qualified engineers in accordance with BS 7671 (IET Wiring Regulations) and applicable UK regulations. We are a NICEIC Domestic Installer.
2. Quotes and Estimates
- All quotations are provided in writing and are valid for 30 days from the date of issue unless stated otherwise.
- A quote is a fixed price for the described scope of work. An estimate is an approximate cost that may vary.
- Quotes are based on information provided at the time. If additional work is required (e.g. due to unforeseen conditions), we will notify you and obtain approval before proceeding.
- VAT will be shown separately on all quotes and invoices where applicable.
3. Acceptance of Work
Work is confirmed when you accept our written quote in writing (by email or signed quote return). Verbal instructions may be accepted for minor works but a written record will be provided before or immediately after.
By instructing us to proceed, you confirm that you have the authority to commission the work (e.g. as the property owner, tenant with permission, or authorised agent).
4. Payment Terms
- Payment is due within 14 days of the invoice date unless otherwise agreed in writing.
- For larger projects, we may require a deposit prior to commencement and stage payments during the works.
- We accept payment by bank transfer, card, or cheque. Details will be provided on your invoice.
- Late payments may incur interest at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
- We reserve the right to withhold certificates and documentation until full payment has been received.
5. Access and Site Conditions
- You are responsible for ensuring clear and safe access to the work area on the agreed date(s).
- Where work requires isolation of the electricity supply, you should make arrangements for this in advance.
- If access is not available on the agreed date and we are not given reasonable notice (minimum 24 hours), an abortive visit charge may apply.
- You should disclose any known hazards on site prior to our visit (e.g. asbestos, known wiring faults).
6. Materials and Equipment
Unless otherwise agreed, we will supply all materials required to complete the quoted work. Materials remain our property until full payment has been received. We use quality, compliant products but reserve the right to substitute equivalent materials where necessary.
If you supply your own materials or equipment, we accept no liability for faults, failures, or incompatibility arising from those items.
7. Certification and Compliance
On completion of notifiable work, we will issue the relevant electrical certificates (e.g. Electrical Installation Certificate, Minor Works Certificate, or EICR) as required by the relevant regulations. Certificates will be provided once full payment has been received.
We are responsible for notifying Building Control of notifiable work under Part P of the Building Regulations, where applicable, as a NICEIC Domestic Installer.
8. Defects and Warranty
- We provide a 12-month workmanship warranty on all completed electrical installations, commencing from the date of completion.
- Manufacturer warranties on equipment and materials are separate and will be passed on to you where applicable.
- Defects must be reported to us promptly. We will not be liable for defects caused by misuse, third-party interference, or failure to maintain equipment in accordance with manufacturer guidance.
- Our warranty does not cover fair wear and tear or damage caused after handover.
9. Liability
We carry full public liability insurance and employers' liability insurance. Our liability to you shall not exceed the total value of the contract for the relevant works.
We are not liable for indirect or consequential losses arising from our work, including but not limited to loss of income, business interruption, or damage to existing decorations or finishes unless caused by our negligence.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10. Cancellation
- You may cancel or postpone a booking with at least 48 hours' notice at no charge.
- Cancellations with less than 48 hours' notice may incur a charge to cover preparation costs and lost time.
- If we have already ordered materials specifically for your job, their cost may be recoverable if the order cannot be cancelled.
- For consumer contracts, you have a 14-day right to cancel under the Consumer Contracts Regulations 2013. If you request work to begin within this period, you may be charged for work carried out if you subsequently cancel.
11. Health & Safety
Our engineers will comply with all applicable health and safety legislation. You must ensure the work environment is safe for our team to operate in. We reserve the right to suspend or refuse work where conditions pose a risk to health and safety.
12. Disputes
If you are not satisfied with our work, please contact us in the first instance so we have the opportunity to resolve the matter. We aim to respond to all complaints within 5 working days.
If we are unable to resolve a dispute, the matter may be referred to the NICEIC for adjudication as part of their Domestic Installer scheme.
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We reserve the right to update these terms from time to time. The version in force at the time you accept a quote will apply to that contract.
